Sexual abuse against women

Introduction.

Sexual abuse is that behavior that threatens the victim’s freedom or sexual indemnity, without mediating violence or intimidation in its realization and without the consent of the victim. On the other hand, sexual aggression is the behavior that without the consent of the victim, mediating violence or intimidation in its realization, threaten the sexual freedom of this.

Developing

Violence against women is a clear violation of human rights, which is present in all societies without distinction of races, social status, cultural level or geographical places. As the company progresses, more and more formed and culturally open, the commission of many crimes is reduced, as we can see in the following graphic that includes the decrease in homicides in Europe.

However, sexual aggressions show an upward trend throughout Europe and specifically in Spain, as we will develop below and we can appreciate in the following graph prepared by Eurostat.

Then we ask ourselves the following question, why does this large number of aggressions occur?

Multitude of studies, such as the World Report on Violence and Health published in 2003, indicate that two types of aspects, individual and community ones influence. They agree that the feeling of belonging to a group, alcohol consumption or psychotropic substances, a scarce or poor education, patriarchal structure of society and opinions favorable to gender inequality are determining factors for these aggressions to occur.

We can understand that one of the most influential factors are the traditional and social norms favorable to male superiority, such as conception in some social circles that violation is a sign of masculinity and the little rigorous legal and community sanctions against violence,as well as the difficulty of trying this type of crime.

Statistics

The Women’s Institute and for equal opportunities (IMIO) is an agency assigned to the Ministry of Presidency Relations with the Courts and Equality, which aims to promote and promote equality and facilitate inclusion. This Institute replaced the “Women’s Institute and in the General Directorate for Equal Opportunities” after Law 15/2014, of September 16 (BOE, September 17, 2014). The Women’s Institute was created by Law 16/1983, of October 24.

The IMIO has a database called “women in figures”, which produces annually together with the National Statistics Institute (INE).

According to this study, in 2017, the latest registered year, there were 1.313 sexual assaults to women, assuming a 91.75% of the total sexual aggressions committed in Spain between men and women. Regarding aggressions with penetration to women, a total of 906 were committed, assuming 93.02 %. For their part, a total of 118 sexual assaults were committed to men and a total of 68 aggressions with penetration.

According to the Ministry of Interior and the IMIO itself, since 2012 there has been an increase in crimes against sexual freedom. While in 2012 there were a total of 6.787 aggressions against sexual freedom of women, in 2016 were 7.240 and in 2017, figure at 8 would shoot.018.

With regard to arrests for sexual aggressions according to the Ministry of Interior, in 2016 a total of 5.028 men were arrested and charged in Spain for crimes against sexual freedom, on the other hand 252 women were charged. It is for this reason that we are going to focus especially on this work on sexual violence against women.

The report on crimes against freedom and sexual indemnity made in 2017 by the Ministry of Interior emphasizes a high seasonality of sexual attacks, since the number of attacks from 2012 to 2017, in the months of December or January, did not exceed 4000, while in the summer months it reaches 6000.

As of August 7, 2019, in Spain there were a total of 377 crimes of sexual aggression with penetration, only one less than on the same date of 2018, specifically in Andalusia and Catalonia, from 40 to 54 and from 110 to 122respectively.

On the other hand, in the Basque Country the number of aggressions have been reduced, although minimally from 28 to 24.
